TERMS AND CONDITIONS

Client must be 18 (eighteen) years or older age and understand and agree with the following terms and conditions.

These terms and conditions apply to bookings or reservations you make with Jasil Travel and Tours over the phone or by email as well as online reservation transactions made via our website: https://www.jasiltraveltours.com. These terms and conditions govern our transactions with the client. It is client’s responsibility to understand the agreement  entered into with Jasil Travel and Tours.

SUMMARY

The following is a geist of importance:

  • Reservation booking commences with the sign up & submition of the booking form and initial down payment or full payment of the Tour price. 
  • Change of mind is not applicable in the agreement.
  • Prices or Rates, even confirmed blocked bookings, may  be subject to change.
  • Confirmed bookings may be non-refundable if cancelled by client.
  • We will be entitled to retain our service / surcharge fees even if a booking is cancelled or does not proceed for any reason which is not our fault.
  • Client is responsible to make oneself aware of all information relevant to his / her travel / tour plans, including but not limited to visa requirements and health protocols.
  • Jasil Travel and Tours is responsible for arrangements of itinerary of travel or tour as specifically choiced by the client. Thus, inclusions and exclusions limits what are offered and not offered in the tour itinerary.

SCOPE OF AGREEMENT

The Terms and Conditions are entered to as agreement between Jasil Travel and Tours as Seller and Client Buyer. The agreement is final and executable upon the latter signifying through reservation of product and payment (down pay and complete pay). The agreement does not include change of mind in the reservation transaction.

RATES AND TAXES

Price rates quoted are either in Philippine Peso or US Dollar currency as suggested. Please note that price is subject to change at the discretion of the Seller prior to booking. Price change may occur before or after booking depending on matters beyond our control which may increase the cost of product. Factors may include adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Price change is a matter outside the seller’s control.

Prices may include applicable taxes which require payment before departure and can be subject to adjustment when tax increases. Local taxation may also be imposed as charged at some airports or resorts.

TOUR PACKAGES

All offered itinerary Tours with quoted rates are subject to availability and may be withdrawn or varied by the seller without notice.

FEES AND SURCHARGES

Fees and surcharges including booking or reservation fees, cancellation or amendment fees, travel insurance rate may apply accordingly.

CHANGE, CANCELLATION & REFUND

Tour packages are promo offered rates and are fixed and final services. If participation with the product is cancelled by the buyer, it is not transferable to another person, another date or otherwise changed. A change may not be permissible as booking is final and executory. In cases, cancellations/changes/incomplete payment may forfeit the booking. Thus, refunds may not apply if the payment had already been forwarded to the tour supplier and airline.

DEPOSITS AND PAYMENT

To reserve/book/purchase a Tour Package, a payment deposit is required. The deposit down payment or complete payment varies depending on the Tour Product booked and lead time to travel. Some Tour products require full payment at the time of booking and we will advise the payment amount at the finalization of booking. All deposits are non-refundable for changes of mind or cancellations by the buyer. Whereupon a deposit has been collected, final payment is required not later than one (1) week before departure date.Failure to complete the final payment by the due date may result the booking/reservation being cancelled and deposits forfeited.

Payments transacted through bank deposit and other online resources may take up to three (3) business days to process. If buyer pays through such method, buyer will need to make the payment at least three (3) business days before the actual due date of booking. Buyer shall notify Jasil Travel and Tours of the payment once it has been made.

Personal or Business Cheque payments are not accepted. We only accept cash, deposits through our BDO and GCash Financial Accounts.

INFORMATION

Jasil Travel and Tours is solely responsible to arrange a booking of Tour Product in accordance to buyer’s choice and instructions. The buyer has to be aware of all information that is necessary or desirable to know  so as maximize optimum use of the Tour Product and to undertake travel generally. It is recommended to be particular with passport and visa requirements. Buyers are also encouraged to be responsible to further investigate and confirm any matters that are applicable to the tourist.

SPECIAL REQUESTS

Buyers shall inform the seller regarding any special requirements or requests one may have for his/her travel arrangements such as special meal, seating requests, room type or disabled access, etc. prior to making the booking. Request may entail add on payment. If buyer does not specifically inform the seller, Jasil Travel and Tours will assume that client do not have any such requirements or need, and the booking will be made on that basis.

TRAVEL DOCUMENTS

As a general rule, (for visa application) tourist’s travel documents shall be available for collection weeks prior to departure; however, this will also depend on individual arrangements. Tourists shall review their travel documents carefully and advise us immediately of any errors in names, dates or timings.

TRAVEL AGENCY

We act as an agent for and sell various travel related products as an agent on behalf of numerous transport, accommodation and other service providers such airlines, coach, rail and cruise line operators as well as travel wholesalers (Suppliers). Any brochures or promotions provided by Jasil Travel and Tours  to you are supplied by Suppliers, or are prepared by us based on content supplied by Suppliers, and we accept no liability for errors in that material.

Your oral or written instructions to us are authority for us to make travel bookings on your behalf and to arrange relevant contracts between you and the applicable Supplier. Notwithstanding this authority, we do not have any fiduciary duty to you. W exercise care in the selection of reputable for, the Products provided by the Suppliers, who are third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by the Supplier. It is recommended that you read fully the terms and conditions before finalising the transaction.

Specifically, if for any reason (excluding fault on our part) any Supplier is unable to provide the Product for which the buyer have contracted either at all, or to the requisite standard, your remedies are against that Supplier and not against Jasil Travel and Tours.

LIABILITY

To the extent permitted by law, we do not accept any liability in contract, tort or otherwise for any ingury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, an event of Force Majeure affecting the tourist, us or a Supplier or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law. In particular, we disclaim any liability for any consequential loss, including loss of enjoyment or amenity. This liability clause is subject to the buyer’s rights under the Philippine Consumer Law and nothing in these terms and conditions is intended to limit any rights the buyer may have under the Philippine Law.

Without limitation of the disclaimer of liability in the previous paragraph, any obligation we have to the to the buyer will be suspended during the time and to the extent that we are prevented from, or delayed in, complying with that obligation by an event of Force Majeure.

Your rights with respect to a confirmed booking affected by an event of Force Majeure will be subject to the terms and conditions of the relevant Supplier.

GOVERNING LAW

If any dispute arises between the buyer and the seller, the laws applicable in Philippine Law will apply. Both irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Philippine Law, and waive any right that you may have to object to an action being brought in those courts.

SUMMARY OF OBLIGATIONS

Before transacting a booking or reservation, it is important that the buyer meet the following requirements:

  • You are eighteen (18) and above and have sufficient funds to pay for the tour services.
  • You have read our terms and conditions and if booking for third parties warrant that you have their authority to do so and have conveyed these terms and conditions to them. You agree to indemnify us and the Supplier against any claims from third parties who have not in fact been properly informed.
  • You have read the terms and conditions applicable and agree to be bound by those.
  • You are responsible for checking the accuracy of all documents provided to you.
  • You are responsible for confirming departure times of any booked services at least 24 hours prior to travel.
  • You warrant and acknowledge.
  • You accept that passports, visas and other required identification documents are your responsibility.

DEFINITIONS

Seller, we, us means all about travel, and where the context permits, travel consultant.

Consultant means an employee of all about travel, with authority to book travel products.

You means a buyer person who makes a booking for a product with Jasil Travel and Tours.

Supplier means a third party company or person who provides Products, including a wholesaler of Tour Products.

Product means travel and holiday related travel and tourism services including accommodation, leisure activities and various forms of transport, including packaged combinations thereof.

Travel Documents means any document (whether in electronic form or otherwise) used to confirm an arrangement with Supplier, including (without limitation) airline tickets, hotel vouchers and tour vouchers.

Force Majeure means an act of God, peril of the sea, accident of navigation, war (including civil war), sabotage, riot, insurrection, civil commotion, coup d’ etat, national emergency, martial law, fire (including wildfire), explosion, lightning, flood, tsunami, cyclone, hurricane, tornado or other major weather event, earthquake, landslide, volcanic eruption or other natural catastrophe, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public health crisis, radiation or radioactive contamination, national strike or other major lack of availability of labor, raw materials or energy beyond the control of the affected party. For the avoidance of doubt, the inability of a party to make a profit or avoid a financial loss, changes in market prices or conditions, or a party’s inability to perform its obligations due to insufficiency of finance does not in itself constitute Force Majeure.
